Salesforce.com CEO on Microsoft Suit: What’d You Expect From a Patent Troll?

Microsoft’s patent-infringement suit against Salesforce.com has drawn a scathing response from Marc Benioff, the customer relationship management software provider’s mercurial CEO. During a company conference in Singapore, Benioff slagged the software giant for filing the suit, branding it a patent troll.

“Patent trolls are part of the industry today; that’s just the way it is,” he said. “We’ve dealt with them before and we’ll deal with this situation in the same exact way. I’m just very disappointed in this, from a former leader of our industry, that they would do this.”

Benioff’s remarks today echo those he made during a May 20 earnings call, though this time he exercised a bit of restraint and stopped short of decrying Microsoft (MSFT) as a bunch of “alley thugs.”

His message, I suppose, is that Salesforce.com (CRM) isn’t much worried by Microsoft’s suit–though perhaps it should be, given the limited patent portfolio in its defense arsenal and Microsoft’s endgame here. As analyst Rob Enderle wrote last week:

Microsoft wants to set an example and losing isn’t an option. In addition the patents in question are key to being able to defend Microsoft’s existing market making the combination into one of the most important legal efforts that Microsoft is likely to undertake. This means they probably won’t settle, will fund the effort fully, and will do whatever it takes to make it successful.

Google Opens the Black Box a Bit

One of the longstanding gripes about Google’s AdSense platform: Publishers have no idea how much money the search giant is generating from the ads it displays on their sites.

That’s going to start changing, Google announced this morning. The company is laying out the revenue splits for both its content and search partners: Publishers will receive 68 percent and 51 percent of revenue, respectively. And Google says it will start providing more detailed accounting to publishers going forward.

Plenty of caveats here: The splits don’t apply to all the AdSense products Google offers (games, for instance, are not included). They don’t apply to big publishers, who get to negotiate their own terms with Google (GOOG). And Google isn’t promising to maintain the splits indefinitely.

But some transparency is better than no transparency. And Google feels confident it won’t lose any accounts in the process. But just in case you were considering shopping around:

When considering different monetization options, we encourage you to focus on the total revenue generated from your site, rather than just revenue share, which can be misleading. For example, you would receive $68 with AdSense for content for $100 worth of advertising that appeared on your site. If another ad network offers an 80% revenue share, but is only able to collect $50 from ads served on your site, you would earn $40. In this case, a higher revenue share wouldn’t make up for the lower revenue yield of the other ad network.

That’s a gauntlet thrown down to rival ad networks: Just to try to beat us. Anyone want to take the bait?

Ctrip Sees Challenge in Online Bookings

One of the biggest challenges for China’s largest online travel booking company, Ctrip, is getting existing customers to go online.

Though having users book flights and hotels through a website rather than a call center is more profitable, two-thirds of Ctrip’s bookings are done through its call centers, according to CEO Fan Min. That means only a slightly higher percentage of users today are going through Ctrip.com than five years ago, and Fan believes it will take another few years for the percentage to increase to 35 percent.

“Each percentage point is hard-earned,” Fan says. “It’s a matter of consumer behavior” even among Ctrip’s wealthier users, he says. Compared to U.S. travelers, people in China tend to book their travel at the last minute and “find it’s more convenient to do it by just picking up the phone.”

With Microsoft Launching Office 2010, Google Takes a Swipe

Microsoft is set to launch Office 2010 on Wednesday, making the software available to businesses, and Google is using the opportunity to tout its own software for companies — Google Docs.

In an official blog post, Google encouraged people to “consider an alternative: upgrading Office with Google Docs.” Google has been encouraging businesses to switch platforms for some time now, but the introduction of Office 2010 presents it with another chance to take a direct swipe at Microsoft. “If you choose this path,” Google enterprise product management director Matthew Glotzbach writes in the post, “upgrade means what it’s supposed to mean: effortless, affordable, and delivering a remarkable increase in employee productivity.”

The post is part of Google’s attempt to move people from software such as Microsoft Office to Google’s offer of “cloud computing” — a term for Web-based software. Proponents of such software say it allows documents to be shared more easily and that it cuts down on expenses because companies no longer need to buy servers to handle the data. Microsoft too is expanding its Web-based offerings with Office 2010, after offering Outlook online for years.

But “cloud” software also has raised questions about the security of data that is stored with an outside vendor, such as Google. Google’s report earlier this year that hackers from China had attempted to access Gmail accounts raised concerns about the security of that information, for example, although analysts have said that performance of cloud systems is more reliable than that found in most small and medium businesses.

Microsoft, which has long dominated the market for office software, says Google’s efforts are not a match for Office. “There is no competitive solution that comes close to what Microsoft offers,” a Microsoft spokeswoman said.

Google, which charges $50 per user per year for use of its upgraded Google Docs software, acknowledges the strength of Office in the business world. Previously, Google CEO Eric Schmidt has said the company’s offerings aren’t as good as established software like Microsoft’s but that 80% parity is good enough for most people. In the latest post, the company says that users “probably already own Office 2003 or 2007 (or maybe Office 2000?).” And to counter that, the company proposes that businesses use Google Docs in addition to older versions of Office.

Microsoft, not surprisingly, disagrees with that approach. “This underscores they do not understand the needs of businesses,” the Microsoft spokeswoman said. “This approach would require businesses to manage two systems and create a poor quality experience for workers. Not only does the approach decrease productivity, it increases costs.”

Nokia’s New Focus Is Mobile Services? Sure It’s Not Lawsuits Against Apple?

Nokia might not be able mount a reasonable challenge to Apple in the smartphone market, but it can certainly mount one in court. The company escalated its legal battle with the iPhone maker this morning, lodging a fourth patent-infringement complaint against it.

Filed in Federal District Court in the Western District of Wisconsin, the suit alleges that Apple’s (AAPL) iPhone and iPad 3G infringe on five Nokia (NOK) patents related to enhanced speech and data transmission, the use of positioning data in applications, and innovations in antenna configurations.

“Nokia has been the leading developer of many key technologies in mobile devices,” said Paul Melin, general manager, Patent Licensing at Nokia. “We have taken this step to protect the results of our pioneering development and to put an end to continued unlawful use of Nokia’s innovation.”

Nokia first sued Apple in October 2009, claiming the iPhone violated 10 of its patents covering various wireless data, speech coding, security and encryption technologies.

Then, in December, Nokia filed a complaint with the U.S. International Trade Commission alleging that Apple infringes its patents “in virtually all of its mobile phones, portable music players and computers.”

Shortly thereafter, the company sued Apple in U.S. District Court in Delaware, making similar allegations.

Apple declined comment, but counterclaims Apple filed against Nokia last December offer a bit of insight into what its thinking on the matter might be.

In 2007, Apple introduced the iPhone a ground-breaking device that allowed users access to the functionality of the already popular iPod on a revolutionary mobile phone and Internet device. The iPhone is a converged device that allows users to access and ever expanding set of software features to take and send pictures, play music, play games do research, serve as a GPS device and much more….The iPhone platform has caused a revolutionary change in the mobile phone category.

In contrast, Nokia made a different business decision and remained focused on traditional mobile wireless handsets with conventional user interfaces. As a result, Nokia has rapidly lost share in the market for high-end mobile phones. Nokia has admitted that, as a result of the iPhone launch, “the market changed suddenly and [Nokia was] not fast enough changing with it.

In response, Nokia chose to copy the iPhone, especially its enormously popular and patented design and user interface….

As Anssi Vanjoki, Nokia’s executive Vice President and General Manager of Multimedia, stated at Nokia’s GoPlay event in 2007 when asked about the similarities of Nokia’s new offerings to the already released iPhone: “[i]f there is something good in the world, we copy with pride.” True to this quote, Nokia has demonstrated its willingness to copy Apple’s iPhone ideas as well as Apple’s basic computing technologies, all while demanding Apple pay for access to Nokia’s purported standards essential patent. Apple seeks redress for this behavior.

Samsung No. 1 Among U.S. Mobile Phone Makers, Apple No.6

The latest metrics on the U.S. mobile market from comScore, published Thursday, are about what you’d expect. Among mobile network operators, Verizon (VZ) ranked highest with 31.1 percent of the market during the three-month period ending March 2010. It was followed by AT&T (T) with 25.2 percent, Sprint Nextel (S) with 12 percent and T-Mobile with 5.1 percent.

Among mobile phone manufacturers, Samsung narrowly beat out Motorola (MOT) for the top spot with a fraction of a percent more than the 21.9 percent its rival claimed. LG Electronics ranked second with a 21.8 percent market share and Research in Motion (RIMM), and Nokia (NOK) ranked fourth and fifth with dueling 8.3 percent shares. And where does Apple (AAPL) and its iPhone, which seems to have such broad mindshare these days, figure in the U.S. mobile OEM market? Andrew Lipsman, senior director of Industry Analysis at comScore (SCOR), tells me it ranks sixth with a five percent share. (Hear that Adobe?)

Clearly, Apple has some way to go before it cracks the Top 5, but the fact that the company has managed to claim so significant a share of the entire mobile phone market with a single smartphone that’s been available for less than three years is extraordinary.

How to Convert MPEG to iPad

After downloading the Aiseesoft iPad Video Converter, double click the installation package to install. Then run the software.
